FAMILY UNIT
What is it?
The right to family unity, understood as the right to maintain, create or reconstitute one’s own family unit, is a fundamental right of the person provided for and protected by our Constitution and by other international and European convention texts. Therefore, in order to promote the unity of the family, as well as to promote the social and cultural integration of foreign citizens in the country of residence, two methods have been established governed by the Consolidated Immigration Act:
Family reunification
Family reunification is a procedure that allows family members of a foreign citizen already residing in Italy to obtain a residence permit to join their family member.
Family Cohesion
Family cohesion is aimed at relatives already present in the territory who hold a residence permit for reasons other than family travel or who are in possession of a short-term visa or temporary authorization to enter for tourism.
Both procedures are aimed at:
✓ spouse who is not legally separated and is at least eighteen years old;
✓ minor children, including those of the spouse or born out of wedlock, unmarried, provided that the other parent, if any, has given his or her consent;
✓ dependent adult children, if for objective reasons they cannot provide for their own essential living needs due to their state of health that leads to total disability;
✓ dependent parents, if they do not have other children in the country of origin or provenance, or parents over sixty years of age, if the other children are unable to support themselves due to documents, serious health reasons.
